What is the H2B Visa?

The H2B visa is a temporary work visa that allows U.S. employers to hire foreign workers for temporary non-agricultural jobs when there are not enough U.S. workers available.

These positions are typically seasonal, peak-load, or one-time occurrence jobs. The H2B visa is valid for up to one year and can be extended for a maximum of three years.

The H2B Visa Process

Employer Process
  1. 1File a temporary labor certification application with the Department of Labor.
  2. 2Conduct recruitment efforts to prove no qualified U.S. workers are available.
  3. 3Receive a temporary labor certification from the Department of Labor.
  4. 4File Form I-129 (Petition for Nonimmigrant Worker) with USCIS.
  5. 5Receive approval of the H2B petition.
  6. 6Notify workers of approval and provide necessary documentation.
Worker Process
  1. 1Receive job offer from a U.S. employer with an approved H2B petition.
  2. 2Complete DS-160 (Online Nonimmigrant Visa Application).
  3. 3Pay visa application fee.
  4. 4Schedule and attend visa interview at the U.S. Embassy or Consulate.
  5. 5Receive visa approval and travel to the United States.
  6. 6Begin temporary employment with the U.S. employer.
